Terms of Use — Big Brain Barbell

1. Agreement to Terms

Big Brain Barbell ("the App") is developed and operated by Tarnished Edge Labs LLC ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Big Brain Barbell is an iOS application that provides automated, algorithm-generated strength training programs and workout tracking. The App generates training programs, tracks your workouts, and adjusts programming based on your logged performance. All training data is stored locally on your device and, optionally, synced via your personal iCloud account.

4. Subscriptions & Payments

Big Brain Barbell offers a monthly auto-renewing subscription that unlocks full access to the App's features.

Billing: Payment is charged to your Apple ID account at confirmation of purchase.
Auto-Renewal: Your subscription automatically renews each month unless you cancel at least 24 hours before the end of the current billing period.
Cancellation: You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then.
Free Trials: If a free trial is offered, the trial period converts to a paid subscription at the end of the trial unless you cancel beforehand. Unused portions of a free trial are forfeited upon purchasing a subscription.
Refunds: All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels in accordance with Apple's refund policies.
Price Changes: We may change subscription pricing at any time. Price changes take effect at the start of the next billing period following notice. Your continued use after a price change constitutes acceptance of the new price.

5. Intellectual Property

The App, including its code, design, algorithms, training protocols, and content, is the intellectual property of Tarnished Edge Labs LLC and is protected by applicable copyright and intellectual property laws. The App is licensed to you, not sold. You may not:

Copy, modify, or distribute the App or its content
Reverse engineer, decompile, or disassemble the App
Remove or alter any proprietary notices or labels
Use the App's training algorithms or programming logic to create a competing product

6. User Data

All training data you enter into the App is stored on your device and remains your property. We do not operate servers that store your personal data. If you enable iCloud sync, your data syncs through your personal iCloud account, which is governed by Apple's privacy policy.

In release builds, the App sends crash and error reports to Sentry, a third-party error monitoring service. These reports include technical information such as device type, operating system version, and error details, but do not include your training data or personal information. 7. Acceptable Use

The App is licensed for your personal, non-commercial use only. You agree not to:

Redistribute, resell, or sublicense the App
Use the App for any unlawful purpose
Attempt to interfere with the App's functionality or security
Use the App on behalf of any third party without authorization

8. Nature of the Service

Big Brain Barbell provides automated, algorithm-generated training programs for strength training. The app is a software tool and is not a substitute for the guidance of a certified personal trainer, strength and conditioning coach, or medical professional. No human reviews or customizes the programs generated for you.

9. Assumption of Risk

You acknowledge that participation in any exercise or strength training program carries inherent risks, including but not limited to: muscular, ligament, or tendon injury; joint damage; cardiovascular events; and in extreme cases, serious injury or death. You voluntarily assume all such risks by using this app and following its generated programs.

10. Medical Clearance

You should consult with a qualified physician or healthcare provider before beginning any exercise program, especially if you have any pre-existing medical conditions, injuries, or health concerns. By using this app, you represent that you have obtained any necessary medical clearance to engage in physical exercise.

11. User Responsibility

You are solely responsible for:

Learning and using proper exercise form and technique
Selecting appropriate weights for your ability level
Warming up adequately before training
Stopping immediately if you experience pain, dizziness, or discomfort
Ensuring your training environment and equipment are safe

The app cannot observe or correct your form.

12. No Guarantees

Tarnished Edge Labs LLC does not guarantee any specific fitness outcomes, performance improvements, or health benefits. Results vary based on individual factors including genetics, nutrition, recovery, consistency, and proper execution of exercises.

13. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Tarnished Edge Labs LLC does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Tarnished Edge Labs LLC's total liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim. In no event shall Tarnished Edge Labs LLC be liable for any indirect, incidental, special, consequential, or punitive damages.

15. Release of Liability

To the fullest extent permitted by applicable law, you release and discharge Tarnished Edge Labs LLC, its members, affiliates, and agents from any and all claims, demands, or causes of action arising from injuries, damages, or losses sustained while using the app or following its generated programs, except in cases of gross negligence or willful misconduct.

16. Indemnification

You agree to indemnify and hold harmless Tarnished Edge Labs LLC and its members from any third-party claims, liabilities, damages, or expenses (including reasonable attorney's fees) arising from your use of the app or participation in any training program generated by the app.

17. Third-Party Services

The App is distributed through the Apple App Store and may use Apple services including iCloud for data sync and StoreKit for subscription management. Your use of these services is governed by Apple's terms and policies. The App also uses Sentry for crash and error reporting in release builds. Your use of the App constitutes acceptance of data processing by these third-party services as described in our Privacy Policy.

18. Apple EULA Terms

These Terms are between you and Tarnished Edge Labs LLC, not Apple. Tarnished Edge Labs LLC, not Apple, is solely responsible for the App and its content. You acknowledge that Apple has no obligation to furnish maintenance or support services for the App. To the extent any warranty applies, Apple is not responsible for any product warranty, whether express or implied. Apple is not responsible for addressing any claims relating to the App or your use of the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

19. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the courts located in the State of Ohio.

21. Modifications to Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms. If a change materially reduces your rights, we will make reasonable efforts to notify you.

22. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Tarnished Edge Labs LLC regarding the App and supersede all prior agreements.
